General terms and conditions of business


1. Scope

The following terms and conditions apply to all orders placed via our online shop.

2. Contracting parties, conclusion of contract

The purchase contract is concluded with Mabookids.
By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking on the order button. Immediately after submitting the order, you will receive another confirmation by email.

3. Contract language, contract text storage

The language available for concluding the contract is German or English.
We save the contract text and send you the order data and our general terms and conditions by email. You can view the contract text in our customer login.

4. Processing time

The processing time after receipt of payment is 10-21 working days, depending on the product (Mon-Fri excluding weekends and holidays + the shipping time depends on the service provider). If there are multiple items, the longest processing time automatically applies.

Due to delays in the supply chain or very high order volumes, processing times may also be longer. In this case, the customer will be actively informed.

5. Delivery conditions

In addition to the stated product prices, shipping costs are also added. For further information, see the Shipping section.
We do not deliver to packing stations.

For non-EU countries, the service provider may vary depending on the delivery time and shipping costs. Please note that in the case of non-EU countries and certain import borders, additional customs fees may apply. These are to be borne solely by the buyer.

We commission DPD Deutschland GmbH as our shipping service provider - upon completion of the purchase, the buyer gives his consent to commission DPD Deutschland GmbH and its current terms and conditions for the transport of the order.

6. Payment

In our shop you can generally use the following payment methods (the processing time always begins with receipt of payment):
Bank transfer, Shopify Payments, credit card.

7. Retention of title

The goods remain our property until full payment.

8. Transport damage

If goods are delivered with obvious transport damage, please complain about such errors to the deliverer as soon as possible and contact us immediately. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you will help us to assert our own claims against the freight carrier or transport insurance.

9. Warranty and guarantees

Unless expressly agreed otherwise below, the statutory liability for defects applies.
The limitation period for claims for defects in used goods is one year from delivery of the goods.
The above restrictions and shortening of time limits do not apply to claims based on damages caused by us, our legal representatives or vicarious agents
• in case of injury to life, body or health,
• in the event of intentional or grossly negligent breach of duty or malice,
• in the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner can regularly rely (cardinal obligations)
• within the framework of a guarantee promise, if agreed or
• to the extent that the scope of application of the Product Liability Act is open.
Information on any additional guarantees that may apply and their exact terms and conditions can be found on the product itself and on special information pages in the online shop.

10. Liability

We are always liable without limitation for claims based on damages caused by us, our legal representatives or vicarious agents.
• in case of injury to life, body or health,
• in the event of intentional or grossly negligent breach of duty,
• in the case of guarantee promises, if agreed, or
• to the extent that the scope of application of the Product Liability Act is open.
In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives or vicarious agents, liability is limited to the damage foreseeable at the time the contract was concluded and which must typically be expected to occur. In all other respects, claims for damages are excluded.

11. Dispute settlement

The European Commission provides a platform for online dispute resolution (ODR), which you can find here http://ec.europa.eu/consumers/odr/. Consumers have the opportunity to use this platform to resolve their disputes.
In order to settle disputes arising from a contractual relationship with a consumer or as to whether such a contractual relationship even exists, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The General Consumer Arbitration Board of the Center for Arbitration eV, Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de, is responsible. We will participate in dispute resolution proceedings before this board.

12. Exchange and return              

Please note that all products are custom-made. They are only manufactured by us after we receive your order and are not prefabricated. Therefore, according to Section 312g Paragraph 2 No. 1 of the German Civil Code, no right of cancellation applies here.

Important: Since this is a custom order, if you return the item you will only receive a voucher for the purchase price. The return costs are borne by the buyer, and a refund is not possible due to the custom order.

Claims for warranty/guarantee (e.g. in the case of material defects) remain valid.

As a gesture of goodwill, you can return your order within 14 days of receipt. Please notify us of this in advance by email to mabooshop@gmx.de . Returns outside of these deadlines will be refused. Please be sure to note this.

For the return shipment, an insured shipment must be selected so that the whereabouts of the shipment can be traced by both parties in the event of problems and/or loss and, in the negative case, is also insured.

For any other type of return, the buyer is liable for any damage/loss that may occur. Furthermore, we reserve the right to offset the lower return costs against the product voucher.               

Orders cannot be cancelled after purchase/payment!

Discontinued models and outlet items are excluded from the exchange/return policy.
